CASES OF NOTE

Bassler v.Stephens Institute 

Millstein & Associates P.C. obtained a defense award after trial on behalf of its client the Academy of Art in a Class Action suit requesting $60 million in damages.

The class consisted of former students of the Academy of Art who resided in its dormitories.  The plaintiffs claimed the students were tenants under the San Francisco Tenant Ordinance and were entitled to fines and penalties.  The case was dismissed by the Court after the plaintiff presented their case in chief on bifurcated issues

Conseco Life Insurance 

Co-lead counsel in a national class-action suit brought by policyholders against Conseco Life Insurance Company. Settled for $27 million in the Northern District of California.

David Millstein represented policyholders claiming that improper cost of insurance charges were added to universal life policies, to the detriment of thousands of policyholders. After his appointment as co-lead counsel for the national class, he settled the matter for $27 million in the United States District Northern District of California. 

FDIC v. Kidwell 

Defended lending officer in bank failure case.

After FDIC sued lending officers in connection with the Eureka Federal Savings bank failure, David Millstein represented a lending officer, through trial, in U.S. District Court, in the Northern District of California.

Parker v. McCaw

David Millstein obtained a defense award on behalf of a company charged with violating a compensation agreement with its attorney-employee, on grounds the agreement violated the Code of Professional Responsibility for attorneys.
